How is that tax evasion? You are allowed to sell shares to realize losses for tax purposes. For publicly listed shares, one day is considered a sufficient period of time, after which the sold shares can be bought back. There are even court rulings on this.

I personally wouldn’t risk trying to sell the shares to my wife to claim the tax benefit. With bad luck, the tax authorities might interpret it differently.
